Clarity Health Care Group Pty Ltd (CHC) is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

Personal Information

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, gender, age, date of birth, mailing or street address, email addresses, contact telephone numbers, facsimile numbers, health and financial information.

This Personal Information is obtained in many ways including applying for employment, correspondence, by telephone and facsimile, by email, via our website www.clarityhealthcare.com.au, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information, we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

  • Your information will be kept in accordance with The Health Records Act and all relevant privacy legislation.

Clarity Health Care utilise Halaxy to store and manage health information including health records and billing data. Halaxy are an Australian company who have 256-bit bank grade security and encryption; meaning consumer records, notes, and payment information are protected to the same level required by Australian banks. Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:

  • For the primary purpose for which it was obtained

  • For a secondary purpose that is directly related to the primary purpose

  • With your consent; or where required or authorised by law.

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information from you or someone providing your personal information on your behalf. However, in some circumstances we may be provided with information by third parties such as your employer or contracting organisations, referral agencies, a service provider or from a publicly available record. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

  • to stay in touch and send you marketing, promotional and fundraising messages and other information that may be of interest to you note, we would only use non-health information for marketing, promotional and fundraising purposes 

  • to comply with our legal obligations, resolve any disputes that we may have with any of our users, and enforce our agreements with third parties;

  • to effectively carry on a business or other commercial relationship with you; and to consider your employment application.

Once you have provided us with your personal details we may send you direct marketing communications and information about our programs and services. This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Spam Act and the Privacy Act. 

You may opt-out of receiving marketing materials from us by contacting us using the details set out below or by using the opt-out facilities provided (eg an unsubscribe link).

We may also market our services to you generally – including via social media, advertising through our website or through third party websites and other digital or non-digital platforms. We will always do this in accordance with our legal requirements and if we use a third party to do so, we will only do so with our trusted partners.

Security of Personal Information

We may hold your personal information in either electronic or hard copy form. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical measures to protect your personal information.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

Your health records will only be released to a third party with your consent. However, in exceptional circumstance (such as a medical emergency) Clarity may need to share health information. This would involve discussing only the pertinent details of your case. In rare situations, the disclosure of your health information can be authorised by law (subpoena).

Clarity Health Care Group Pty Ltd will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information. In order to protect your Personal Information we may require identification from you before releasing the requested information.

We may collect personal information about you when you use and access our website.

While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol address assigned to your computer.
